PINPOINT TRAVEL HEALTH LIMITED (“Company”) TERMS AND CONDITIONS of SUPPLY of SERVICES
PLEASE NOTE THE DISCLAIMERS IN CLAUSES 1.5, 2.2, 3.6.2, 6.2, 6.3, 6.4 AND 8.1 BELOW and THAT ONCE YOU PLACE AN ORDER AND PAY FOR THE SERVICE THE SERVICE IS PROVIDED IMMEDIATELY, SO THERE IS NO OPPORTUNITY TO CHANGE YOUR MIND
1. Introduction
1.1 Pinpoint Travel Health Limited is a company registered in England with number 11517766 and has its registered office at Nexus, Discovery Way, University of Leeds, Leeds, LS2 3AA (“Company”/”us”/”our”/”we”).
1.2 These terms and conditions apply to your purchase of any services from us via the website, www.pinpointtravelhealth.com (the “Website”).
1.3 The Website is designed to allow you to purchase a report setting out the vaccines and anti-malarial medicines you require based on your travel itinerary (the “Travel Health Brief”/”Brief”).
1.4 Use of the services we supply on the Website is only intended for individuals aged 18 or over, who are resident in the UK and who are travelling overseas from the UK and returning to the UK.
1.5 The Company is not a medical practitioner, nor is it qualified to give medical or pharmacy advice. The Company interprets the advice and guidance provided by NaTHNaC (National Travel Health Network and Centre) in the UK to produce the information in your Travel Health Brief.
2. Accuracy and DISCLAIMER
2.1 Every effort is taken to ensure that the information published on the Website and in a Brief is accurate and informative.
2.2 The content of the Website and any Brief is provided for information only. It is not intended to replace a consultation with an appropriately qualified medical practitioner. The Company does not accept responsibility for any loss, damage or injury that arises from the use of the Website or reliance on any information on the Website or in a Brief. For further details see clauses 3 and 4.4 below.
3. Travel Health Information Service
3.1 The Company provides an on-line web application that will generate a Travel Health Brief, which will, in most cases, suggest disease risk, appropriate vaccines and/or anti-malarial medicines based on the information that you input into the application, including details of your travel itinerary (the “Travel Health Application”).
3.2 You are responsible for entering honest, complete and accurate information into the Travel Health Application. The Company has no responsibility to you if you fail to enter honest and accurate information and this generates results that are inaccurate or inappropriate for your circumstances.
3.3 If the information you input into the Travel Health Application results in one or more vaccines or anti-malarial medicines being identified in the Brief as suitable for your circumstances, you should contact a qualified healthcare professional in order to receive the relevant vaccines or anti-malarial medicines.
3.4 When you have entered all of the information required by us, you will be asked to pay the cost of the Brief plus any relevant sales tax. After successful payment you will have direct access to the Brief through your online account.
THE PROCESS:
- a) You will be asked to enter details of your itinerary (places, arrival and return dates).
- b) We then provide you with a risk summary – listing all of the diseases that might be present on your trip.
- c) You then create an account, providing minimal data, as requested by us. (This will include providing answers to risk activity questions – eg will you be camping on your trip?)
- d) You may be required to give us information on your medications and health status (depending on our partner’s requirements).
- e) We then process your information to produce a full Travel Health Brief.
- f) If you want to access the full Travel Health Brief you will be asked to pay the relevant fee plus VAT.
- g) You will need to enter your credit card details, make a payment and you will then have direct access to the Brief.
- h) An email receipt is provided to you.
3.5 When you visit a travel clinic or pharmacy they will require further information from you to ensure that any vaccines or antimalarials we have identified which may be suitable for your trip are also suitable for you from a medical standpoint. They may need further information from you to determine this.
3.6 You acknowledge and agree that:
- 3.6.1 if you have completed a Travel Health Application you have consented to supplying the Company with your personal information in order to generate a Brief;
- 3.6.2 no vaccine or medicine is guaranteed to be 100% effective and, notwithstanding you receiving a vaccine or taking anti-malarial medicines identified in your Brief as being appropriate, you may nevertheless contract the disease that such vaccines and/or medicines are intended to inoculate you against. Please request full details of the efficacy of the vaccines and/or medicines you select from the pharmacist or health professional;
- 3.6.3 if you experience any side-effect(s) from any vaccine or anti-malarial medicine identified in your Brief, you will contact a health professional for consultation, monitoring and, if necessary, treatment. Please note that some medicines have minor side-effects that may be entirely normal, however if you have any concerns you must contact a health professional; and
- 3.6.4 you have provided complete and truthful information with no omissions that could reasonably be judged to be required in determining the appropriate medicine for your circumstances.
4. Consumer rights
4.1 These terms and conditions do not affect your statutory rights.
4.2 Your legal right to change your mind: We complete the service immediately once we have received payment, so there is no option to change your mind about a purchase after you receive our email confirmation.
4.3 If you think that something is wrong with the content of our Website and/or your Brief please contact us at support@pinpointtravelhealth.com .
4.4 Your legal rights are summarised below. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk. Remember too that you have several options for resolving disputes with us.
4.5 Summary of your key legal rights: The supply of a Brief is the supply of services and the Consumer Rights Act 2015 says:
- 4.5.1 you can ask us to repeat or fix a service if it’s not carried out with reasonable care and skill, or get some money back if we can’t fix it;
- 4.5.2 if a price hasn’t been agreed upfront, what you’re asked to pay must be reasonable; and
- 4.5.3 if a time hasn’t been agreed upfront, it must be carried out within a reasonable time.
5. Pricing
5.1 The price of the Brief as displayed on the Website from time to time is quoted in pounds sterling.
5.2 While the Company’s goal is a 100% error-free Website and Brief, there is no guarantee that any content is accurate or complete, including price information and medicine specifications. If price errors are discovered, they will be corrected on the Website and the corrected price will apply to your Brief. The Company reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions (including after a Brief has been generated).
5.3 Full payment for the Brief must be made by credit or debit card before the Brief will be supplied to you.
6. The Company’s responsibilities to you
6.1 If you think that something is wrong with our service and/or the content of your Brief please contact us on support@pinpointtravelhealth.com. We don’t compensate you for all losses caused by us or our services – see details in 6.2, 6.3 and 6.4 below.
6.2 We’re responsible for losses you suffer caused by us breaking this contract unless the loss is:
- 6.2.1 unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable);
- 6.2.2 caused by a delaying event outside our control. As long as we have taken the steps set out in the section we’re not responsible for delays outside our control;
- 6.2.3 avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions for use;
- 6.2.4 a business loss. It relates to your use of a product for the purposes of your trade, business, craft or profession.
6.3 Subject to clause 6.5 below, if the Company fails to comply with these terms and conditions, or is otherwise negligent, it shall only be liable to you for a sum equal to any fees you have paid for the Brief. We consider this to be reasonable as we only supply you with information and not medical or risk advice.
6.4 Subject to clause 6.5 below, the Company will not be liable for:
- 6.4.1 loss of income or revenue,
- 6.4.2 loss of business,
- 6.4.3 loss of profits,
- 6.4.4 loss of anticipated savings, or
- 6.4.5 loss of data that results from the acts or omissions of the Company and/or any pharmacist or health professional that provides you with any vaccines and/or anti-malarial medications that have been suggested in the Brief.
6.5 Nothing in this agreement excludes or limits the Company’s liability for:
- 6.5.1 death or personal injury caused by the Company’s negligence;
- 6.5.2 fraud or fraudulent misrepresentation; or
- 6.5.3 any other matter that cannot be limited at law.
7. Intellectual property
7.1 All copyright and other intellectual property rights in the material contained in each Brief are owned by the Company or its licensors. The material contained in any Brief may not be modified or reproduced by any means and/or in any format or media whatsoever without the express prior written consent of the Company, except that you may download, save electronically, send and print off an unlimited number of copies of the Brief to share with pharmacy staff and/or health professionals only.
8. Non-reliance on information
8.1 The content on or generated by the Website, including that contained in a Brief:
- 8.1.1 is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the information on the Website or in your Brief;
- 8.1.2 has not been prepared with consideration for your personal health condition, any health condition, therapeutic agent, laboratory test or diagnostic procedure available; and
- 8.1.3 is derived from information provided by a wide variety of sources which may be inaccurate or incomplete due to the failure of individual countries to disclose completely or accurately the extent and nature of the health risks within their borders and/or health-related requirements. Such content can therefore provide only an indication of the travel and health risks an individual may face in any given country, and there is no guarantee that all risks or health-related requirements have been identified.
8.2 You agree that the Company provides no medical, pharmaceutical, or other professional advice or patient services in connection with its provision of a Brief.
8.3 You agree that you are solely responsible for determining that the information on the Website and/or in a Brief, including the suggested vaccines and/or medicines, is suitable for your circumstances.
8.4 You understand that the Company has no ability to verify patients’ health conditions or their medications.
9. General
9.1 You will be subject to the terms and conditions in force at the time you request provision of services from the Website.
9.2 All notices given by you to the Company must be sent to support@pinpointtravelhealth.com or the form on the “Contact Us” page. The Company may give notice to you at either the email or postal address you provide to us when placing an order. Notice will be deemed received and properly served as follows:
- 9.2.1 immediately when posted on our Website,
- 9.2.2 24 hours after an email is sent, or
- 9.2.3 three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove: in the case of a letter, that such letter was properly addressed, stamped and placed in the post; and, in the case of an email, that such email was sent to the specified email address of the addressee.
9.3 The Company will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations to you pursuant to these terms and conditions that is caused by events outside our reasonable control.
9.4 The Company may transfer its rights and obligations under these terms and conditions to another organisation. We will tell you in writing if this happens and will try to ensure that the transfer will not affect your rights under the contract.
9.5 If the Company fails at any time, to insist upon strict performance of any of your obligations under any of these terms and conditions, or if the Company fails to exercise any of the rights or remedies to which it is entitled pursuant to these terms and conditions, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.
9.6 If any or all of the terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
9.7 These terms and conditions and any document expressly referred to in them constitute the whole agreement between us for the supply of a Brief and supersede all previous discussions, correspondence, negotiations, previous arrangements, understanding or agreement between us relating to the provision of information by the Company.
9.8 We each acknowledge that in respect of any contract for services between us, neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them.
9.9 Each of us agrees that our only liability in respect of those representations and warranties that are set out in these terms and conditions (whether made innocently or negligently) will be for breach of contract.
9.10 Provision of information and services through the Website and any dispute or claim arising out of or in connection with these terms and conditions or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law and will be subject to the exclusive jurisdiction of the courts of England.
9.11 Any phrase introduced by the terms “including”, “include”, “in particular” or any similar expression shall be construed as illustrative and shall not limit the sense of the words preceding those terms.
10. Privacy Policy
10.1 The Company will treat your personal data with all due care and in compliance with the Data Protection Act 2018 and the UK GDPR that is, the retained EU law version of the General Data Protection Regulation ((EU) 2016/679).
